Arch Coal Reaches Agreement With U.S. Requiring Upgrade of Eastern Mines, Fine

Arch Coal and its International Coal Group subsidiaries will upgrade mining operations in five states to guarantee Clean Water Act compliance under a proposed consent decree (U.S. v. Arch Coal, S.D. W.Va., No. 2:15-cv-11838, 8/6/15). In addition to instituting a compliance management system (CMS), Arch will pay a $2 million civil penalty for violations of the act by its 14 ICG subsidiaries. The settlement announced Aug. 6 by the Environmental Protection Agency and the U.S. Justice Department resolves hundreds of Section 301 and Section 402 permitting violations stemming from illegal discharges at ICG mines in Kentucky, Pennsylvania, Maryland, Virginia and West Virginia.
