Texas Superfund Order Can Come Under Hazardous, Solid Waste Sections, Court Says

An administrative order may be issued under both the hazardous and solid waste sections of the Texas state Superfund law, a Texas appeals court ruled April 8 (Texas CEQ v. Exxon Mobil Corp., 2016 BL 110691, Tex. App., 3d Dist., No. 03-14-00667-CV, 4/8/16). The court rejected the argument of the Texas Commission on Environmental Quality that it issued an order only under the hazardous waste provision, limiting review to a substantial-evidence standard of review.
