A party entering into an agreement with the federal government to settle its Superfund liability can only pursue a contribution claim for payments made under the agreement, the federal government told the Eastern District of Wisconsin April 4 (United States v. NCR Corp., E.D. Wis., No. 10-CV-910, motion filed 4/4/16). The Superfund cost recovery claim filed by paper maker Appvion Inc. alleging Army Corps liability should therefore be dismissed, the government said.
