EPA to Rewrite Toxic Wastewater Limits Rule, No Deadline Set

American Electric Power, the nation's largest electric utility, hopes the EPA will delay all compliance deadlines for toxic wastewater limits on power plants in the wake of the agency's decision to rewrite limits for certain wastestreams. The Environmental Protection Agency told the U.S. Court of Appeals for the Fifth Circuit in a motion filed Aug. 14 of its decision to rewrite limits for three of six power plant wastestreams imposed by a 2015 rule (SW. Elec. Power Co. v. EPA, 5th Cir., No. 15-60821, motion 8/14/17). The rewrite would address limits from gasifying coal, using scrubbers to reduce sulfur dioxide emissions, and transporting bottom ash.
