Methane Emissions Standards Frozen Again as EPA Mulls Appeal

The EPA has two weeks to decide whether it will appeal a ruling that forced it to reinstate methane limits for new oil and gas wells after a federal appellate court reversed course. The U.S. Court of Appeals for the District of Columbia Circuit July 13 granted the Environmental Protection Agency's motion to delay enforcement of a recent decision that overturned a 90-day stay of the methane regulation (Clean Air Council v. EPA, D.C. Cir., No. 17-1145, 7/13/17). The court struck down the stay in a July 3 decision, which found the short-term stay to be an abuse of the agency's authority.
