Mountain Coal Agrees to Colorado Mine Operating Permit

Mountain Coal Co. won’t withdraw its application for an operating permit for its mine in Colorado, and it will flare emissions until the permit is issued, according to a proposed settlementfiled Tuesday in a federal court in the state.The filing in the U.S. District Court for the District of Colorado resolves a dispute with environmental groups who said the company’s West Elk Mine needs a Title V permit due to nonfugitiveemissions. The company applied for such a permit in March 2020.Mountain Coal will flare emissions from the mine’s ventilation boreholes in accordance with the mine safety and health administration ventilation plan, according to the proposed consentdecree. It will also limit emissions during startup, shutdown, and maintenance with “good air pollution control practices,” the filing says.
