DOJ Denies Army Corps Is ‘Racing’ to Grant Pebble Mine Permit

The U.S. Army Corps of Engineers’ denial of a key permit for the planned Pebble Mine goes against an environmental group’s claim that it’s “racing ahead” to grant the permit, theDepartment of Justice told the Ninth Circuit in litigation over the EPA’s approval of the project.The Corps denied Pebble’s application for a Clean Water Act permit for the project Nov. 25. However, that doesn’t affect the lower court’s “correct” finding that the EnvironmentalProtection Agency’s’s decision isn’t reviewable, the DOJ said in a letter filed in the appeals court Nov. 27.
