A waste recycler's failure to notify its insurer of a suit by neighbors for environmental violations, nuisance, and negligence lets the insurer off the hook for the $50 million default judgment, a federal court said. Notice of the claims to Westfield Insurance Co. by a third party didn't trigger the insurer's coverage duty, the U.S. District Court for the Northern District of Indiana said June 4.
