An environmental group has filed what is likely the first-of-its-kind legal challenge arguing that the cost-benefit analysis used by a federal agency is unlawful because it failed to consider the benefits of reducing carbon dioxide (CO2). At issue in the litigation filed by the Sierra Club on May 23 against the National Highway Traffic Safety Administration (NHTSA) corporate average fuel economy (CAFE) rule finalized in March, which increased the light truck efficiency standard by 1.8 miles per gallon (mpg). The regulation would have been far more stringent if NHTSA had factored in the benefits of CO2 control, a Sierra Club source says.
