The pesticide industry is weighing legislative and litigation options for addressing the recent appellate ruling that vacates a controversial EPA regulation exempting pesticide spraying "on or near" waterbodies from Clean Water Act (CWA) permit requirements - a ruling that will subject scores of chemical spraying activities for mosquito control, agricultural uses, and other activities to discharge permit requirements. CropLife America, the pesticide industry trade association, said in a Jan. 9 statement that the group is considering asking the full U.S. Court of Appeals for the 6th Circuit to review the ruling en banc, or may file new litigation to address the issue. The group is also considering asking Congress to step in, the statement says.
