EPA is crafting a rule under the Safe Drinking Water Act (SDWA), which provides authority for EPA's Underground Injection Control (UIC) program, to create a new class of UIC wells for CCS. The rule, considered critical for overseeing CCS under any future greenhouse gas emissions program, is designed to prevent contamination of underground sources of drinking water, which can be contaminated if exposed to high concentrations of carbon dioxide. EPA issued its proposal in July 2008 and a supplemental notice requesting further data on the subject in August 2009. Industry and environmental groups have been meeting to discuss recommendations on the requirements for the new wells and reached a tentative agreement on most points in October.
