High Court Case May Complicate Hill Push To Curb EPA's Climate Rules

The Supreme Court's first-time decision to review a climate nuisance case could create short-term complications for congressional efforts to block or delay EPA climate regulations because policy stalling the rules could undercut petitioners' arguments to the court that the nuisance claims are displaced by other federal climate policy. If EPA climate regulations are stalled or delayed indefinitely, it becomes harder to argue to the high court that government rules to address climate change are right around the corner, says a source closely tracking the litigation. The Supreme Court Dec. 6 announced it would hear American Electric Power, et al., vs. Connecticut, et al, in which utility defendants are seeking to reverse a lower court ruling allowing a nuisance case against several power companies to proceed.
