EPA is sidestepping an emerging industry effort to revive a Bush-era policy that allows utilities to avoid installing new air quality controls if they comply with die former administration's cap-and-trade emission rule for power plants, saying officials will defer a decision on the issue until it replaces the Bush EPA rule.rnIndustry wants to revive the Bush-era declaration that facilities' compliance with the Clean Air Interstate Rule (C AIR) - the cap-and-trade rule to cut power plant emissions in 31 states that a federal court remanded to EPA for revision -automatically satisfies a Clean Air Act requirement that they also install reasonably available control technology (RACT) to limit emissions of nitrogen oxides (NOx) and sulfur dioxide (SO2).
