Local stormwater agencies and a key congressman are raising doubts about whether EPA has statutory authority to mandate "green" infrastructure practices in Clean Water Act stormwater permits, while saying the practices might not be cost-effective methods for protecting water quality compared to conventional stormwater controls.rnThe agency has already included green infrastructure practices as requirements in several specific Clean Water Act municipal separate storm sewer system (MS4) permits, including in Washington, DC, Kansas City, MO, and Philadelphia. But critics say that EPA does not appear to have the authority to mandate such requirements.
