A federal appeals court has remanded Epa's air toxics rule for Portland cement facilities to the agency after finding the agency failed to consider how a related incinerator air rule could potentially alter the cement rule's emission limits, a move that the court suggests could result in the agency developing a more stringent cement air toxics rule. In a unanimous decision Dec. 9 in Portland Cement Association (PCA) v. Epa, Judges Karen LeCraft Henderson, David Tatel and Janice Rogers Brown also ordered the agency to stay its emission standards for clinker storage piles at cement facilities.
