EPA Argues States Lack Standing In Lawsuit Opposing Air Transport Rule

EPA is arguing that states regulated by its utility emissions cap-and-trade program lack standing to sue over the rule and is opposing the states' bid for a federal appeals court to stay the rule, saying the states fail to show direct harm they would suffer as a result of the rule and suggesting the court dismiss the suits because of the lack of standing. Environmentalists, public health groups and "clean" energy companies are also intervening on EPA's behalf to fight requests to stay the Cross-State Air Pollution Rule (CSAPR) trading program, filing as part of consolidated litigation over the rule in the U.S. Court of Appeals for the District of Columbia Circuit. Proponents of the rule worry that a stay would delay reductions of utility emissions of nitrogen oxides (NOx) and sulfur dioxide (SO_2) from upwind plants.
