Revised EPA Climate BACT Guide Rejects Calls For Major Policy Changes

EPA in a just-issued revised version of its guidance for how to determine best available control technology (BACT) for air permits with greenhouse gas (GHG) limits makes only minor changes from an earlier version and rejects calls for major changes to key policies such as when carbon capture should be considered BACT. The revised guidance, issued March 25, updates guidance the agency issued in November to help air permitting authorities and industry develop BACT reviews for Clean Air Act prevention of significant deterioration (PSD) and Title V permits ahead of EPA's GHG permit rule that took effect Jan. 2. At the time, EPA faced heavy criticism for only accepting comment on the draft for 14 days. The new guide does not open a new public comment period.
