EPA says it will accept public comment for 60 days on a controversial guidance document issued last November that instructs EPA regional offices to include numeric flow limits in its stormwater permits where practicable, a measure that industry has decried as a major policy shift that requires a formal rulemaking process. In a March 17 memorandum posted on the agency's website, EPA announced that it would be accepting comment through May 16 on the Nov. 12 memorandum that urges permit writers to include flow limits in National Pollutant Discharge Elimination System (NPDES) stormwater permits. In its announcement, EPA says it is taking comment to allow stakeholders to "raise questions and objections about the substance of this guidance and the appropriateness of the application of this guidance to a particular situation."
