Industry Urges Court To Reject Setting Deadline For EPA Coal Ash Rule

Power and mining industry groups are urging a federal district court to dismiss a suit filed by coal ash recyclers and environmentalists seeking a deadline for EPA to issue a coal waste disposal rule, with the industry groups echoing the agency's claim it has no duty to release the rule. In an Oct. 25 motion for summary judgment in the case Appalachian Voices, et al. v. Lisa Jackson, a case pending before the U.S. District Court for the District of Columbia, intervenor defendants Utility Solid Waste Activities Group (UWAG) and National Mining Association (NMA) argue that EPA is not required to review its CCR regulations because they are not governed by non-discretionary provisions of the Resource Conservation & Recovery Act (RCRA).
