EPA Draws Multiple Industry, Environmentalist Suits Over Drilling Air Rules

Oil and gas industry groups and environmentalists have filed multiple lawsuits challenging EPA's recently finalized emissions rules for oil and gas drilling, with industry contesting several provisions including controls on storage tanks while environmentalists are criticizing EPA's decision not to regulate drilling emissions of methane. EPA published the final rule setting new source performance standards (NSPS) to curb criteria pollutants from the sector and national emissions standards for hazardous air pollutants (NESHAP) to cut air toxics in the Aug. 15 Federal Register, triggering a 60-day clock to file suit over the rules in the U.S. Court of Appeals for the District of Columbia Circuit.
