EPA, environmentalists and states are fighting Texas' attempts to link the recent Supreme Court ruling over President Obama's health care law to the agency's takeover of greenhouse gas (GHG) permitting, rejecting Texas' claims that the ruling underscores limits on the federal government's ability to "commandeer" state programs. In an Aug. 1 notice of supplemental authority to the U.S. Court of Appeals for the District of Columbia Circuit, EPA says Texas' attempt to link the health law ruling to the GHG suit are "unsupported, conflating separate constitutional questions."
