Industry officials are warning that EPA's recently proposed plan to assess pesticides' risks to endangered species could violate the Administrative Procedure Act (APA), saying that without additional comment on each revision to the evolving process, chemicals reviewed at the start of the process could be reviewed differently than later reviews. "There's so much of the process that is undefined that will have a tremendous influence over the outcome," Ray McCallister, senior director of regulatory policy for CropLife America, told EPA staff during a Dec. 5 conference call of the Pesticide Program Dialogue Committee (PPDC). "It looks like an administrative process that is not following appropriate administrative procedures, that's one of my concerns," he said.
