EPA is detailing its rationale for rejecting environmentalists' push for a Toxic Substances Control Act (TSCA) test rule for chemicals used in oil and gas drilling, including hydraulic fracturing, but its long-delayed formal response suggests that if advocates were to narrow their request, the agency could consider a future rulemaking effort. In a notice slated for publication in the Federal Register July 11, EPA says environmentalists have not yet provided sufficient evidence to demonstrate the need for a rule requiring chemical manufactures and processors to conduct toxicity tests on their products and turn over the data to EPA.
