Industry, Environmental Groups Sue EPA Over Waste Incinerator Rules

Industry and environmental groups have filed lawsuits over EPA's recently revised emissions rule for commercial and industrial solid waste incinerators (CISWI) and a separate rule defining non-hazardous secondary materials (NHSM), adding to existing suits over a related boiler air toxics rule that EPA revised with weaker emissions limits. The three rulemakings are a package of combustion regulations that the agency first issued in March 2011 under a court-ordered deadline after environmentalists sued claiming EPA was delaying the rules. EPA then immediately launched a rare self-initiated reconsideration of the policies to review industry complaints that the standards were too strict and costly. Following that review, EPA in December finalized changes that softened the rules.
