Industry, Environmentalists Spar Over EPA Boiler MACT Compliance Guide

Industry groups and environmentalists are sparring over a new EPA guidance on complying with its contested boiler air toxics rule for small "area" source units, with industry welcoming the agency's steps to address uncertainty about key compliance issues while environmental advocates say the guide simply underscores major weaknesses in the boiler rule. The guidance, released as a non-binding "Question and Answer" document in April, is in response to questions EPA received from industry and states over implementation of the area source boiler maximum achievable control technology (MACT) rule, which is separate from another boiler MACT for larger "major" source boilers. A third related emissions rule for commercial and industrial solid waste incinerators (CISWI) also faces an ongoing legal challenge.
