EPA Sees Court Ruling On Data Notices Bolstering RCRA Gasification Rule

EPA and the oil industry, in new letters to a key appellate court, say that a 2004 Clean Air Act ruling supports the agency's position that it provided adequate notice it was considering promulgating a weaker version of a proposal to allow some fuel produced through gasification of hazardous waste to be excluded from strict handling mandates. But environmentalists counter that the ruling in West Virginia v. EPA from the U.S. Court of Appeals for the District of Columbia Circuit has little bearing on their pending challenge to the Resource Conservation & Recovery Act (RCRA) gasification rule, Sierra Club, et al. v. EPA.
