Mining Company Eyes Suit To Force Jobs Impact Review Of EPA Air Rules

Mining company Murray Energy is threatening to sue EPA to force it to meet what it says is a nondiscretionary Clean Air Act duty to continuously review the impact of its air rules on employment, arguing that EPA's pending utility climate rules, air toxics rule for power plants, and other emissions policies will cause major job losses. "Your failure to fulfill this duty prevents Murray Energy from obtaining and using EPA's continuous evaluations of employment effects to address and ameliorate the devastating economic consequences of EPA's actions on the coal industry," writes Squire Sanders attorney Geoffrey Barnes on the company's behalf in a Jan. 21 notice of intent to sue sent to EPA Administrator Gina McCarthy.
