Industry, Environmentalists Win Intervention In Coal Ash Waste Rule Suit

Environmentalists and electric utility groups have won the right to intervene in consolidated litigation over EPA's final rule governing disposal of coal ash, a significant procedural step that will allow the groups to argue directly against each other's positions when substantive briefing starts rather than only mounting claims against EPA. In a Sept. 15 order, the U.S. Court of Appeals for the District of Columbia Circuit granted requests from 13 groups for intervenor status in Utility Solid Waste Activities Group (USWAG), et al., v. EPA, which combines separate suits filed by utility, ash reuse and environmentalist groups over the agency's Resource Conservation & Recovery Act (RCRA) ash disposal rule.
