EPA Defends Rules Underlying 'Completion' Of Air Toxics Policy Mandate

EPA has finalized its finding that it has completed a Clean Air Act mandate to regulate air toxics from sources that represent 90 percent of emissions of seven hazardous air pollutants (HAPs), and is rejecting what it calls advocates' "collateral attack" on years-old rules underlying the conclusion that it has met the air law requirement. In a final rule signed by EPA Administrator Gina McCarthy May 22 but not yet published in the Federal Register, EPA affirms its earlier proposed version of the finding from Dec. 16. The agency says its regulations to date have satisfied Clean Air Act section 112(c)(6) which says EPA by Nov. 15, 1995 must list industrial sources for regulation accounting for 90 percent of seven identified "persistent" and "bioaccumulative" HAPs.
