EPA Suggests Diversity Of Financial Instruments Needed To Aid CERCLA Rule

EPA has released a report evaluating the capacity of the marketplace to provide the hardrock mining industry with financial responsibility instruments it will likely need to comply with an upcoming Superfund rule, with the agency indicating current insurance and surety markets appear to be "sound," but suggesting a diverse range of instruments may be needed to shore up sufficient coverage. At the same time, EPA expects the financial assurance requirements under the new rule - to be issued under the Comprehensive Environmental Response, Compensation & Liability Act's (CERCLA) section 108(b) - to be phased in over four years. "This should help to provide lead time for the markets to respond to demand and companies to obtain assurance," the report says.
