Pesticide producers are backing EPA's claim that it needs more time to review scientific data on the commonly-used insecticide chlorpyrifos before deciding whether to ban it, but the industry groups are arguing the agency's six-month review estimate is inadequate and that it will need at least a year. "The serious flaws in the Agency's analytical process, the unprecedented techniques the Agency proposes to use, and the severe negative consequences of acting on the basis of a flawed analysis, were not before the Court when it set the current deadline," says a July 5 amicus filing with the U.S. Court of Appeals for the 9th Circuit filed by CropLife America, the Agricultural Retailers Association, and other pesticide industry groups.
