EPA is urging a federal appellate court to dismiss on procedural grounds a lawsuit brought by environmentalists challenging the agency's exemptions for concentrated animal feeding operations (CAFOs) from reporting requirements for hazardous substance emissions, saying the petitioners lack standing for the suit. The Department of Justice, on behalf of EPA, argues in a March 7 respondent's brief in Waterkeeper Alliance, et al. v. EPA that petitions challenging two hazardous substance reporting rule exemptions under the Comprehensive Environmental Response, Compensation & Liability Act (CERCLA) and the Emergency Planning and Community Right-to-Know Act (EPCRA) should be dismissed for lack of jurisdiction. The case is before the U.S. Court of Appeals for the District of Columbia Circuit.
