Trump critics are urging the Biden administration to restore EPA's internal draft proposal seeking to list two per-and polyfluoroalkyl substances (PFAS) as "hazardous substances" under the Superfund law after departing officials released an 11th-hour plan that the critics say "gutted" the original proposal and only asks whether the PFAS should be designated. Given that the Trump administration's advance notice of proposed rulemaking (ANPRM) will not be published in the Federal Register for some time, "the Biden administration should yank it and issue instead the proposed rule" as EPA career staff originally wrote it in 2019, Betsy Southerland, a former EPA water and waste office official now with the Environmental Protection Network, tells Inside EPA.
