Proposed Settlement Would End Years-Long Fox River CERCLA Litigation

The Justice Department (DOJ) has reached a proposed settlement with the two remaining potentially responsible parties (PRPs) at the massive Lower Fox River and Green Bay Superfund site, moving toward ending years-long litigation among PRPs and the government over a sediment cleanup expected to exceed $1 billion in costs. DOJ earlier this month lodged the proposed settlement in United States and the State of Wisconsin v. NCR Corp., et al, in the U.S. District Court for the Eastern District of Wisconsin. Polychlorinated biphenyls (PCBs) from decades of producing, reprocessing and recycling carbonless copy paper contaminated a nearly 40-mile area of the Lower Fox River and thousands of square miles of Green Bay, according to the state and federal governments in a July 2018, brief in the case.
