The new Australian federal government model for Work, Health and Safety (WHS) legislation has now been implemented in most states and it requires that all duty holders ensure that risk management is implemented. The key issue for engineers is how this should be done. The purpose of this article is threefold: 1. to highlight the different risk mitigation strategies 2. to argue for the current As Low As Is Reasonably Practical (ALARP) hazard-based method as opposed to the precautionary-based system which is driven by legal considerations 3. to discuss the dilemma for design engineers when implementing the new WHS legislation.
