These days,most employers are well aware of the increased litigation in the area of wage-and-hour law.In the last decade,the number of filings under the federal Fair Labor Standards Act(FLSA) has more than tripled,with many of these suits now joining state-law claims to the federal claims.Indeed,it seems as though every week a news headline appears describing the latest collective-and/or class-action lawsuit brought against an employer for overtime compensation,minimun-wage violations,or improper classification of enpliyees.Although these lawsuits garner the most publicity,employers should be wary of the growing trend in another,less well-known area of the wage-and-hour arena:state late-paychech laws.
