The past several months have continued the trend under the Obama administration of executive agencies ramping up their regulatory efforts in the name of increased "protection" of workers. The most significant of these recent developments was the long-awaited issuance of the Equal Employment Opportunity Commission's (EEOC's) final regulations related to the Americans with Disabilities Act Amendments Act (ADAAA), which significantly expanded the meaning of disability and made it much easier for plaintiffs to establish their coverage under the Americans with Disabilities Act. The Department of Labor (DOL), National Labor Relations Board (NLRB), and Occupational Safety and Health Administration (OSHA) have also gotten into the game with less sweeping, but nevertheless significant, regulatory actions aimed at maximizing legal protection of workers in a variety of ways.
