Arbitration agreements compelling employers and employees to resolve employment-related disputes have become routine in the modern workplace. The National Employment Lawyers Association reports that 15 to 20 percent of U.S. employers, covering approximately 30 million workers, or 25 percent of the non-unionized workforce, require their employees to sign some form of arbitration agreement or otherwise require employees to consent to the employer's policy that forces employment disputes into arbitration, rather than state or federal court.
