Several aspects of the majority and dissenting opinions are striking and worthy of comment. First, it is surprising that the majority decided to sidestep the issue of the domestic legal effects of a U.S. Presidential executive agreement and declare that the Filipino Constitution requires equality but not parity in the enforceability of international obligations in light of Medellin's recognition of a limited Presidential authority to conclude sole-executive agreements with domestic legal effect.
