A period of adjustment is taking place across the solar industry. Sadly, various enterprises are no longer viable. As a consequence, a lot are looking for an exit from unappealing contracts. Many contracts will provide a lawful exit. Some will not. If you are mixed up in a termination or are contemplating one, here are some things to look out for. Dust off the contract Dust off your contract, get a towel over your head and read the contractual provisions very carefully. A well drafted contract should expressly deal with termination. Sometimes the right to terminate will be at the sole convenience of one of the parties; often the person upstream. Sometimes the right to terminate will only arise on the occurrence of a certain specified default or event, for instance, the insolvency of one of the parties.
