摘要

This study deals with the use of the Internet to resolve cross-border Internet disputes outside of the courts. It identifies a vehicle described as online dispute resolution, or ODR, which the author describes as a progeny of alternative dispute resolution, or ADR, using some of the same processes as mediation and arbitration, but as being different in that it adds new and transformative technology and processes. The book's objectives are identified thus: "This book sets out the process standards with which ODR (and in particular online arbitration) should comply, shows how these standards can be implemented in the real world and considers applicable law and enforcement, thus providing a blueprint of how online arbitration processes should be devised".
