Regulations implementing the Environmental Liability Directive have entered into force in England, affecting virtually all waste operations. Although the "permit defence" is included, it offers no real comfort.rnWhere there is an imminent threat of environmental damage, the Regulations require operators to take measures to prevent harm to protected species/ habitats, water and land. They also require operators to remediate such damage where it has already occurred. Enforcement is via notices for prevention or remediation, detailing the measures to be taken by the operator, served by the enforcing authority, with non-compliance an offence.
