摘要

This Part of the AIPJ offers three complex articles dealing with difficult questions in the law of copyright and commercial designations. Sarah Bellingham returns to a question considered by Hill J in the 1999 dispute over the televising of the Sydney New Millennium celebrations; what copyright might subsist in a fireworks show? In that case Hill J observed that "the weakest copyright case ... is the claimed copyright said to exist in the dramatic work originating from the schedule dealing with the fireworks display".1 Here -and with field materials sourced from the famous Australian fireworks firm of Howard & Sons -Bellingham thinks deeply about these reservations expressed by Hill J on the copyright status of fireworks. Her article compels a reconsideration of whether a person who selects the sequence of elements which comprises a fireworks show should be regarded as the author of a dramatic work.
