Clarification of a common statutory test for standing: Argos Pty Ltd v Corbell, Minister for the Environment and Sustainable Development

The High Court recently handed down an important decision in Argos Pty Ltd v Corbell, Minister for the Environment and Sustainable Development (2014) 145 ALD 473; 206 LGERA 96; 315 ALR 44; BC201410457 (Argos). The importance of the decision lies in its clarification of the statutory test for standing found in s 3B(1) of the Administrative Decisions (Judicial Review) Act 1989 (ACT) (ADJR Act). This article examines the decision, and comments on the implications that may arise from it.
