It doesn't exactly roll off the tongue, and it probably won't get a second glance from ADR neophytes, but right now it's arguably domestic arbitration's biggest issue: Can a nonsignatory party successfully file an interlocutory appeal to stay a litigation matter for an arbitration? That's the question that the U.S. Supreme Court has lined up for 2009-the latest arbitration case in what has become the Court's hottest area. In the latest case, the Court could lay out the parameters of the extent to which people and companies that aren't part of an arbitration agreement can use a contract to demand ADR, or stay litigation.
