After being threatened for sanctions by bankruptcy Judge Steven Rhodes, the law firm Kirkland & Ellis and its client, Syncora, issued a public apology (1.usa.gov/1ndanPB) for "any unfounded aspersions" that may have been cast on the mediators, Gerald Rosen and Eugene Driker, in an August 12, 2014 filing in the Detroit municipal bankruptcy proceedings. In that filing, Syncora asked Judge Rhodes not to confirm the reorganization plan, which it characterized as the product of an improper mediation by "conflicted mediators who colluded with certain interested parties to benefit select favored creditors to the gross detriment of disfavored creditors[.]" Syncora also accused Driker of a conflict of interest because his wife was a former member of the city-owned museum's board of directors and cited public statements by Rosen as evidence of his bias.
