Aircraft Halon Bottles Exempted From ODS Import Petition Requirements

In an April 11, 2006 direct final rule (71 FR 18219-18227), EPA exempted entities that import aircraft fire extinguishing system spherical pressure vessels containing Halon-1301 from the import petition requirements applicable to Class Ⅰ ozone-depleting substances (ODS). The petition requirements in 40 CFR Part 82, Subpart A require that an importer provide EPA with detailed information about a shipment 40 days prior to the shipment leaving the foreign port of export. The petition process allows the agency to verify that the ODS to be imported are, in fact, recovered material, and are not virgin material subject to a production or consumption ban.
