Environmental Appeals Board Remands PSD Permit for Refinery Expansion Project

In the June 2, 2008 decision, the EAB remanded the PSD permit to the IEPA because the agency's response to comments on the draft permit failed to specify and explain the provisions of the permit that had been changed. In the decision, the board stated: "On remand, IEPA should specify each provision of the draft permit that has been changed in the final permit decision and provide reasons for each change, supported by record evidence, as is required by 40 C.ER. § 124.17(a) (1). IEPA should supplement the record as necessary during the remand process. Additionally, IEPA may reopen the record for additional public comment as necessary, in accordance with 40 C.F.R. § 124.14. If Petitioners or other participants are not satisfied with IEPA's explanation of changes on remand, Petitioners or other participants with standing may appeal the IEPA determination to this Board pursuant to 40 C.ER. §124.19."
