Revisions Proposed to MACT Standards for Mercury Cell Chlor-Alkali Plants

On June 11,2008 (73 FR 33258-33282), EPA proposed revisions to the maximum achievable control technology (MACT) standards for mercury cell chlor-alkali plants. The proposed rule would require continuous instrumental monitoring of cell room fugitive mercury emissions. In addition, the proposed rule would amend the work practice requirements for controlling cell room fugitive emissions, and would correct a number of errors and inconsistencies in the MACT standards. EPA has proposed the revisions to the MACT standards for mercury cell chlor-alkali plants in response to a petition for reconsideration received from the National Resources Defense Council (NRDC). A petition for judicial review of the MACT standards has also been filed in the U.S. Court of Appeals for the District of Columbia Circuit. The June 11, 2008 action is the agency's proposed response to the petition for reconsideration.
