Mr Justice Warren's recent decision in the 'pilots litigation' {PNPF Trust Company Limited v Taylor and others [2010]) provides the court's most comprehensive attempt to reconcile the operation of the two key pieces of legislation imposing funding obligations on the sponsoring employers of pension schemes: the twin axis of the 'employer debt' legislation deriving from sections 75 and 75 A of the Pensions Act 1995 (1995 Act) ('s75') and the 'scheme specific funding (SSF) regime' established by Part 3 of the Pensions Act 2004. Warren J's judgment addresses how these interrelate, and how they interact with the funding obligations found in the pension trust.
